DATA PRIVACY STATEMENT

In this data protection statement, we inform you about the most important aspects of data protection within the framework of our website. Personal data are informations who may identify you personally in the world wide web. The protection of your personal data is one of our prime concerns. We process your data exclusively on the basis of the legal statutory provisions.

HOW DO WE COLLECT YOUR DATA?

Part of the data is collected to ensure the proper functioning of the website. Other data can be used to analyze tecnical data (e.g browser time and browser version and time of server request ). The operator of the website has a legitimate interest in the storage of cookies to ensure the technically error free and optimized provision of the operator’s services. If your consent to the storage of the cookies has been requested, the respective cookies are stored exclusively on the basis of the consent obtained (cockiebanner); this consent may be revoked at any time.

ONLINE RESERVATION AND DATA COLLECTION

If you book or request a room, your personal data are required. It concerns your title, name, address, place of residence, date of birth, telephone number, email, signature, departure and arrival date, room category, room rate, number of rooms you book, and your payment details. The host of the booking process is BUSY ROOMS GMBH. Essen, Germany . If you make a business booking, we will also collect the name and (address) details of your employer and/or client. We may also collect additional personal information from you that is of importance to our services and that you have provided to us voluntarily.

We only process health-related data in order to provide you with a better services, such as which allergies we should take into account or the fact that you wish to use amenities for the disabled. You are free to deny us health-related information.

As a hotel we are legally obliged to register a number of details of our guests. Additionally, we process certain data in order to be able to implement our services. We have a legitimate interest in processing certain data to protect our business operations and to guarantee the quality of our services.

We will not transfer the data you provide except for your credit card details to our credit card company for payment and to our tax consultant for fulfilling our legal- and tax duty in Austria. We also forward your postal code and year of birth (in pseudonymized and anonymized form) to our municipality and our tourism association. This is done for statistical purposes so that the tourism association can create and evaluate statistics on country of origin and age. The data is forwarded in accordance with Art. 6, para. 1, lit. e (public interest) and lit. f (legitimate prevailing interests) GDPR. You can file an objection at any time for reasons resulting from your particular situation (§ 96 Abs 3 TKG and Art 6 Abs 1 lit a (consent) and or lit b (necessary for the performance of contract as per the directive of European Union law)

If you stop the reservation process all data will be canceled. In case of finalizing a contract with us all private data will be stored for 7 years in compliance with valid applicable laws, regulations and legal procedures.

COOKIES

Our websites and pages use what the industry refers to as “cookies.” Cookies are small text files that do not cause any damage to your device. They are either stored temporarily for the duration of a session (session cookies) or they are permanently archived on your device (permanent cookies). Session cookies are automatically deleted once you terminate your visit. Permanent cookies remain archived on your device until you actively delete them or they are automatically eradicated by your web browser.

In some cases it is possible that third party cookies are stored on your device once you enter our site (third party cookies). These cookies enable you or us to take advantage of certain services offered by the third party (e.g. cookies for the processing of payment services).

The operator of the website has a legitimate interest in the storage of cookies to ensure the technically error free and optimized provision of the operator’s services. If your consent to the storage of the cookies has been requested, the respective cookies are stored exclusively on the basis of the consent obtained (§75 Art. 6 Sect. 1 lit. a GDPR); this consent may be revoked at any time. Any mandatory statutory provisions, especially those regarding mandatory data retention periods, remain unaffected by this provision.

You have the option to set up your browser in such a manner that you will be notified any time cookies are placed and to permit the acceptance of cookies only in specific cases. You may also exclude the acceptance of cookies in certain cases or in general or activate the delete function for the automatic eradication of cookies when the browser closes. If cookies are deactivated, the functions of this website may be limited.

In the event that third party cookies are used or if cookies are used for analytical purposes, we will separately notify you in conjunction with the Data Protection Policy § 76 BDSG, Art. 6 Abs. 1 sent. 1 lit. c and, if applicable, ask for your consent.

If you enter our website for the first time, services of third parties (Borlabs – Benjamin A. Bornschein, Rübenkamp 32, 22305 Hamburg) are also integrated and provided by these third parties on their own responsibility. These date will not be transferred to our knowledge.

These cookies expire after 30 days and are not used for personal identification of the user. Should the user visit certain pages of the website and the cookie has not yet expired, Google and the website can tell that the user clicked on the ad and proceeded to that page.

Many data processing operations are only possible with your express consent. You may revoke your consent at any time with future effect. An informal email making this request is sufficient. The data processed before we receive your request may still be legally processed.

GOOGLE ANALYTICS AND REMARKETING

Our websites use the features of Google Analytics Remarketing combined with the cross-device capabilities of Google AdWords and DoubleClick. This service is provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland („Google“)

This feature makes it possible to link target audiences for promotional marketing created with Google Analytics Remarketing to the cross-device capabilities of Google AdWords and Google DoubleClick. This allows advertising to be displayed based on your personal interests, identified based on your previous usage and surfing behavior on one device (e.g. your mobile phone), on other devices (such as a tablet or computer).

Once you have given your consent, Google will associate your web and app browsing history with your Google Account for this purpose. That way, any device that signs in to your Google Account can use the same personalized promotional messaging.

To support this feature, Google Analytics collects Google-authenticated IDs of users that are temporarily linked to our Google Analytics data to define and create audiences for cross-device ad promotion.

You can permanently opt out of cross-device remarketing/targeting by turning off personalized advertising in your Google Account; follow this link: https://www.google.com/settings/ads/onweb/.

The aggregation of the data collected in your Google Account data is based solely on your consent, which you may give or withdraw from Google per Art. 6 (1) (a) DSGVO. For data collection operations not merged into your Google Account (for example, because you do not have a Google Account or have objected to the merge), the collection of data is based on Art. 6 (1) (f) DSGVO. The website operator has a legitimate interest in analyzing anonymous user behavior for promotional purposes.

This website uses Google AdWords. Customers are told the total number of users who clicked on their ad and were redirected to a conversion tracking tag page. However, advertisers do not obtain any information that can be used to personally identify users. If you do not want to participate in tracking, you can opt-out of this by easily disabling the Google Conversion Tracking cookie by changing your browser settings. In doing so, you will not be included in the conversion tracking statistics.

Conversion cookies are stored based on Art. 6 (1) (f) DSGVO. The website operator Busy Rooms GmbH. Essen Germany has a legitimate interest in analyzing user behavior to optimize both its website and its advertising. You can configure your browser to inform you about the use of cookies so that you can decide on a case-by-case basis whether to accept or reject a cookie. Alternatively, your browser can be configured to automatically accept cookies under certain conditions or to always reject them, or to automatically delete cookies when closing your browser. Disabling cookies may limit the functionality of this website.

FACEBOOK PIXEL

Our website measures conversions using visitor action pixels from Facebook, (Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Irland („Facebook“). These allow the behavior of site visitors to be tracked after they click on a Facebook ad to reach the provider’s website. This allows an analysis of the effectiveness of Facebook advertisements for statistical and market research purposes and their future optimization. The data collected is anonymous to us as operators of this website and we cannot use it to draw any conclusions about our users’ identities. However, the data are stored and processed by Facebook, which may make a connection to your Facebook profile and which may use the data for its own advertising purposes, as stipulated in the Facebook privacy policy. This will allow Facebook to display ads both on Facebook and on third-party sites. We have no control over how this data is used. You can also deactivate the custom audiences remarketing feature in the Ads Settings section.

If you do not have a Facebook account, you can opt out of usage-based advertising from Facebook on the website of the European Interactive Digital Advertising.

NEWSLETTER DATA

If you would like to receive our newsletter, we require a valid email address as well as information that allows us to verify that you are the owner of the specified email address and that you agree to receive this newsletter. No additional data is collected or is only collected on a voluntary basis. We only use this data to send the requested information and do not pass it on to third parties. We will, therefore, process any data you enter onto the contact form only with your consent per Art. 6 (1) (a) DSGVO. You can revoke consent to the storage of your data and email address as well as their use for sending the newsletter at any time, e.g. through the “unsubscribe” link in the newsletter. The data processed before we receive your request may still be legally processed. The data provided when registering for the newsletter will be used to distribute the newsletter until you cancel your subscription when said data will be deleted. Data we have stored for other purposes (e.g. email addresses for the members area) remain unaffected.

YOUR RIGHTS

  • Right to object to the collection of data in special cases;
  • Right to object to direct advertising (Art. 21 GDPR)

In the event that data are processed on the bais of Art. 6 Sect. 1 Lit. E or F GDPR, you have the right to at any time object to the procesing of your personal data basond on grounds arising from your unique situation . This also applies to an profiling based on these provisions.  To determine the legals basis, on which any processing of data is based please consult this data protection declaration, if you log an objection, we will no longer progess your affected personal data , unless we are in a position to present compelling protection worthy grounds fort he processing of your data , that outweigh your interests, rights and freedoms or if the purpose oft he processing is claiming, exercising or defence of legel entitlements (objection persuant to art. 21 sec. 1 GDPR)  

If your perwsonal data is being processed in order to engage in direct advertising, you have the right to at any time object to the processing of your affected personal data fort he purposes of such advertising. This also applies to profiling to the extent that is affiliated with such direct advertising. If you object, your personal data will subsequently no longe be used for direct advertising purposes (objection persuant to ART. 21 sect. 2 GDPR)

  • Right to log a complaint with the competent supervisory agency

 In the event of violations of the GDPR, data subjects are entitled to log a complaint with a supervisory agency, in particular in the member state where they usually maintain their domicile, place of work or at the place where the alleged violation occurred. The right to log a complaint is in effect regardless of any other administrative or court proceedings available as legal recourses.

  • Right to data portability 

You have the right to demand that we hand over any data we automatically process on the basis of your consent or in order to fulfil a contract be handed over to you or a third party in a commonly used, machine readable format. If you should demand the direct transfer of the data to another controller, this will be done only if it is technically feasible.  

The responsible party is the natural or legal person who alone or jointly with others decides on the purposes and means of processing personal data (names, email addresses, etc.).
